Terms and Conditions
These terms and conditions set for the basic rules which apply to cx360.org's services, may change in the future upon notice published on line or otherwise
provided by cx360.org, and every user agrees to comply with them. If
any of the terms or conditions of sale, services, system or pricing is unacceptable to any
user, the user may terminate its account or stop using the services of the system.
The services provided by cx360.org
are expected to change from time to time. cx360.org
reserves the right to change any service offered or the features of any service or it's
system without notice, including changes to access and use procedures.
- Termination and Suspension
Either user or cx360.org
may, at its sole discretion, terminate the users account at any time with or without
reason. cx360.org may, at its sole discretion, suspend a users
account at any time with or without reason. cx360.org
may use all
data files compiled at its discretion. cx360.org
may delete all data,
files, or other information that is stored in the user account upon termination.
Commercial products (including all auto parts
and all other sale items) are sold only under manufacturers original warranty and no other
warranty is available or applicable. cx360.org
is not the
manufacturer of or otherwise responsible for any such products (including all auto parts
and all other sale items). cx360.org makes no warranty of any kind,
either expressed or implied, with respect to the use or non-use of the products available
to users.
- No Warranty; Limitation of Liability
Use of cx360.org's
services and the system and the Internet in general is at user's sole risk. cx360.org
does not warrant that it's services and the system will not be interrupted
or error free; nor does cx360.org make any warranty as to the results
or information obtained from use of its service or system or the internet in general.
cx360.org's services are provided on a "as is," "as
available" basis without warranties of any kind, either expressed or implied,
including implied warranties of merchantability or fitness for a particular purpose, all
of which warranties are hereby expressly disclaimed except to the extent of any warranty
cannot be disclaimed under applicable law. Under the no circumstances shall cx360.org
be liable for any indirect, incidental, special or consequential damages,
including, without limitation, loss of profits. cx360.org
will assume
no liability whatsoever.
The user agrees to indemnify and hold
harmless cx360.org, it's members, it's directors, officers,
shareholders, agents, employees and its other users from any and all claims, liabilities,
damages or expenses, including attorney fees, arising out of or resulting from any and all
use of user's account whether or not authorized.
Users account and right to use cx360.org's services and system is not transferable without
cx360.org's written consent. User agrees to protect its password and account and to keep
them secure from unauthorized users and use.
Electronic mail and other transmissions
passing over the Internet and through cx360.org's system are not
confidential, unless entering special secure areas, specifically designated as such.
Accordingly, cx360.org cannot guarantee privacy of information flow
on normal unsecured links, such as e-mail.
These terms and conditions supercede all
other written and oral communications or agreements with regard to the subject matter. A
waiver or modification of these terms and conditions shall only be effective if in writing
signed by all of the four members of cx360.org
These terms and
conditions shall be governed by and interpreted in accordance with the laws of the
province of Ontario without regard to choice of law principals.
The information and products provided by
cx360.org are taken from sources that we deem reliable. We do not
represent that this is accurate or complete, and should not be relied on as such. Such
information is furnished as a matter of service only and is not deemed an offer to sell or
solicitation on any offer to buy a product or information herein.
CONCLUSION
Use of the system and products available
through cx360.org is at users own risk and user will not hold
responsible in any case cx360.org for any problem, damage, etc.
arising out of the use, misuse or nonuse of cx360.org's system or
products available through it.
